IMVU, INC. ("IMVU", "WE" OR "US") SERVICE TERMS OF USE


THE TERMS AND CONDITIONS (THE "TERMS") SET FORTH BELOW GOVERN YOUR USE OF THE IMVU SERVICE LOCATED AT WWW.IMVU.COM (THE "SERVICE") AND/OR PURCHASE AND/OR USE OF OUR PRODUCTS & SERVICES (THE "PRODUCTS"). THESE TERMS ARE A LEGAL CONTRACT BETWEEN YOU AND IMVU AND GOVERN YOUR ACCESS TO, AND USE OF, THE SERVICE AS WELL AS ANY RELATED PRODUCTS. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, DO NOT ACCESS OR OTHERWISE USE THIS SERVICE, PRODUCTS, OR ANY INFORMATION ON OR RELATED TO THIS SERVICE. YOUR USE OF THIS SERVICE AND/OR ANY PRODUCTS AVAILABLE ON OR THROUGH THIS SERVICE CONSTITUTES YOUR AGREEMENT TO ABIDE BY EACH OF THE TERMS SET FORTH BELOW. IMVU MAY MAKE CHANGES TO THE CONTENT OFFERED ON THE SERVICE, AT ANY TIME WITHOUT NOTICE, AND IMVU CAN CHANGE THESE TERMS AT ANY TIME. IF IMVU CHANGES ANY OF THESE TERMS, IMVU WILL POST THE UPDATED TERMS OF USE ON THE SERVICE. IMVU MAY ALSO SEND REGISTERED USERS A NOTICE OF THE CHANGE TO THESE TERMS. YOUR CONTINUED USE OF THIS SERVICE AND/OR PRODUCTS AFTER SUCH CHANGES HAVE BEEN POSTED ACKNOWLEDGES YOUR AGREEMENT TO THE NEW TERMS. THEREFORE, YOU SHOULD CHECK THE TERMS OF USE POSTED ON THIS SERVICE PERIODICALLY FOR UPDATES AND CHANGES.

YOU MUST BE AGE 13 OR OLDER TO USE THIS SERVICE AND PRODUCTS; IF YOU ARE UNDER AGE 18 YOU MUST HAVE YOUR PARENT OR LEGAL GUARDIAN'S PERMISSION TO USE THIS SERVICE AND PRODUCTS, AS WELL AS HAVE THEM READ AND AGREE TO THESE TERMS.

YOU REPRESENT, ACKNOWLEDGE AND AGREE THAT YOU ARE AT LEAST 18 YEARS OF AGE OR THAT YOU ARE THE PARENT OR LEGAL GUARDIAN OF A USER THAT IS AT LEAST 13 YEARS OF AGE, AND YOU AGREE TO THESE TERMS. ALL IMVU PURCHASES, INCLUDING, WITHOUT LIMITATION, IMVU CREDITS, PASSES, PRODUCTS, BUNDLES, SUBMISSIONS, AVATAR NAMES, AND ALL OTHER VIRTUAL PRODUCTS, WHETHER MADE WITH CREDITS, CURRENCIES, PROMO CREDITS, PREDITS, DEVELOPER TOKENS, CASH OR MONETARY EQUIVALENT, ARE NON-REFUNDABLE, EXCEPT, IN IMVU'S SOLE AND ABSOLUTE DISCRETION.

Disclaimer of Warranties

Your use of this Service is at your own risk. Neither the Materials, Submissions nor the Third Party Content (each as defined below) have been verified or authenticated in whole or in part by IMVU, and they may include inaccuracies, typographical, or other errors. IMVU does not warrant the accuracy of timeliness of the Materials, Submissions or the Third Party Content contained on this Service. IMVU has no liability for any errors or omissions in the Materials, Submissions and/or the Third Party Content, whether provided by IMVU, our users, or our licensors.

IMVU, FOR ITSELF AND ITS LICENSORS, MAKES NO EXPRESS, IMPLIED OR STATUTORY REPRESENTATIONS, WARRANTIES, OR GUARANTEES IN CONNECTION WITH THIS SERVICE, THE PRODUCTS, ANY MATERIALS, SUBMISSIONS OR THIRD PARTY CONTENT, RELATING TO THE QUALITY, SUITABILITY, TRUTH, ACCURACY OR COMPLETENESS OF ANY INFORMATION OR MATERIAL CONTAINED OR PRESENTED ON THIS SERVICE, INCLUDING WITHOUT LIMITATION THE MATERIALS, THE THIRD PARTY CONTENT AND THE SUBMISSIONS OF OTHER USERS OF THIS SERVICE. UNLESS OTHERWISE EXPLICITLY STATED, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS SERVICE, MATERIALS, THIRD PARTY CONTENT, SUBMISSIONS, AND ANY INFORMATION OR MATERIAL CONTAINED OR PRESENTED ON THIS SITE IS PROVIDED TO YOU ON AN "AS IS," "AS AVAILABLE" AND "WHERE-IS" BASIS WITH NO WARRANTIES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD PARTY RIGHTS. IMVU DOES NOT PROVIDE ANY WARRANTIES AGAINST VIRUSES, SPYWARE OR MALWARE THAT MAY BE INSTALLED ON YOUR COMPUTER.

A Special Note About Your Health

If you or anyone in your family has ever had symptoms related to epilepsy (such as, seizures or loss of consciousness) or headaches when exposed to flashing lights or contrasting visual patterns, consult your doctor prior to using this Service. Immediately cease using this Service if you experience any symptoms of dizziness, blurred vision, headaches, eye or muscle twitches, loss of consciousness, disorientation, any involuntary movement or convulsion. If you elect to use this Service, you should take certain standard health and safety precautions, such as avoiding using this Service when tired, taking 10 to 15 minute breaks every hour, sitting a reasonable distance from the screen, and using this Service in a well-lit environment.

Limitation of Liability

NEITHER IMVU NOR ITS LICENSORS SHALL BE LIABLE TO YOU FOR ANY DAMAGES RESULTING FROM YOUR USING, DISPLAYING, COPYING, OR DOWNLOADING ANY MATERIALS, THIRD PARTY CONTENT OR SUBMISSIONS TO OR FROM THIS SERVICE. IN NO EVENT SHALL IMVU OR ITS LICENSORS BE LIABLE TO YOU FOR ANY DAMAGE TO YOUR HEALTH OR FOR ANY INDIRECT, EXTRAORDINARY, EXEMPLARY, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA, REVENUE, PROFITS, USE OR OTHER ECONOMIC ADVANTAGE) HOWEVER ARISING, EVEN IF IMVU OR ITS LICENSORS KNOW THERE IS A POSSIBILITY OF SUCH DAMAGE.

IMVU controls and operates this Service from its headquarters in the United States of America and the Materials, Submissions and/or Third Party Content may not be appropriate or available for use in other locations. If you use this Service outside the United States of America, you are responsible for following applicable local laws.

General Use Restrictions

IMVU provides digital content and products through this Service. Certain information, documents, products and services provided on and through this Service, including content, logos, graphics, sounds and images (together, the "Materials") are provided to you by IMVU and are the copyrighted and/or trademarked work of IMVU or IMVU's contributing partners and/or licensors. Materials do not include Submissions which are items submitted to the catalog by third party developers (as further defined below in the Submissions Section) and do not include Digital Content (as defined below in the Music Store Section). IMVU may provide you with certain proprietary software ("Software") that IMVU allows you to download from the Service.

IMVU grants you a limited, personal, non-exclusive and non-transferable license to use this Service and the Software and to use and display and to make copies incidental to use and display of the Materials solely for your personal use. . Except for the license set forth in the preceding license grant above, you acknowledge and agree that you have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of the Materials or the Software in any manner. This limited license terminates automatically, without notice to you, if you breach any of these Terms. Upon termination of this limited license, you agree to immediately destroy any downloaded or printed Materials or Software. Except as stated herein, you acknowledge that you have no right, title or interest in or to this Service, any Products, Materials or Software.

We may offer updates of the Software, from time to time, for feature enhancement, security or other purposes. We will not automatically update the Software, unless you authorize us to do so.

You agree to comply with all export and re-export regulations and restrictions of the Department of Commerce and other United States agencies and authorities that may apply to the Software. If you are a US Government end user, we are licensing the Software to you as a "Commercial Item" as that term is defined in the US Code of Federal Regulations and the rights we grant you to the Software are the same as the rights we grant to all others under these Terms.

If you violate these Terms, IMVU may terminate and/or suspend your access to this Service and/or use of the Materials, Third Party Content and/or the Products without notice. IMVU prefers to advise you of your inappropriate behavior and to recommend any necessary corrective action. However, certain violations of these Terms, as determined by IMVU, may result in immediate termination of your access to this Service. IMVU has the right to terminate any password-restricted account for any reason. If any of these Terms is found to be inconsistent with applicable law, then such term shall be interpreted to reflect the intentions of the parties, and no other terms will be modified. IMVU's failure to enforce any of these Terms is not a waiver of such term.

These Terms are the entire agreement between you and IMVU and supersede all prior or contemporaneous negotiations, discussions or agreements between you and IMVU about this Service. The proprietary rights, disclaimer of warranties, representations made by you, indemnities, limitations of liability and general provisions shall survive any termination of these Terms.

These Terms will be governed and interpreted pursuant to the laws of the State of California, United States of America, for contracts to be executed and fully performed therein and notwithstanding any principles of conflicts of law. The parties specifically disclaim application of the Convention on Contracts for the International Sale of Goods. You specifically consent to personal jurisdiction in the State of California in connection with any dispute between you and Company arising out of these Terms or pertaining to the subject matter hereof.

You agree that the exclusive venue for any dispute arising out of these Terms or pertaining to the subject matter thereof will be in the state and federal courts in California. You irrevocably waive all rights to bring or participate in any class action suits or claims regarding the matters related hereto. If any part of these Terms is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. These Terms constitute the entire agreement among the parties relating to this subject matter. To the extent a purchase order, confirmation letter, or other communication is inconsistent with these Terms, these Terms will govern, unless expressly agreed in writing otherwise by an executive officer of Company (i.e., regular employees cannot bind the Company).

MUSIC STORE TERMS

IMVU also may act as a music content provider through the IMVU Music Store ("Music Store"). Specifically, the Music Store allows you to purchase digitized versions of audio recordings, and, as applicable, artwork and other information relating to such audio recordings ("Digital Content").You may purchase downloads of Digital Content (as defined below) or the limited right to stream Digital Content within certain areas of the Service with IMVU Credits. The Digital Content can be downloaded or streamed to you and other IMVU users in an IMVU chat room from a playlist queue ("Playlist"). You and other IMVU users accessing streaming Digital Content are prohibited from making any recording of such Streaming Digital Content.

The Digital Content is considered Third Party Content (as defined below in the Third Party Content Section), all right, title and interest of which is the sole property of third party licensors of IMVU. All Sony BMG content made available for digital download through the Music Store is sold directly by Sony BMG Music Entertainment Downloads LLC via VLGroup as its agent.

Upon your payment of the applicable fees for Digital Content, IMVU grants you a non-exclusive, non-transferable license to use the Digital Content for your personal, non-commercial, entertainment use, subject to and in accordance with the terms of these Terms. You may copy, store, transfer and burn the Digital Content only for your personal, non-commercial, entertainment use.

You represent, warrant and agree that you will use the Digital Content available through the Music Store only for your personal, non-commercial, entertainment use. You agree not to take any action that would infringe the rights of the Digital Content's copyright owners and to comply with all applicable laws in your use of the Digital Content. You agree that you will not redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, sub-license or otherwise transfer or use the Digital Content except as expressly permitted above. You are not granted any synchronization, public performance, promotional use, commercial sale, resale,reproduction or distribution rights for the Digital Content. You acknowledge that the Digital Content embodies the intellectual property of a third party and is protected by law. Accordingly, any unauthorized reproduction or distribution of Digital Content violates applicable law.

You agree that IMVU and its licensors has no liability to you for Digital Content that you may find to be offensive, indecent or objectionable.

All sales of Digital Content are final. We do not accept returns of Digital Content. Once you have purchased Digital Content, we encourage you to download it promptly and to make backup copies of it. If you are unable to complete a download after having following the download process, please visit the IMVU Help Center. You bear all risk of loss after purchase and for any loss of Digital Content you have downloaded, including any loss due to a computer or a hard drive crash. We may, from time to time, remove Digital Content from the Music Store without notice.

You do not acquire any ownership rights in the Digital Content as a result of downloading Digital Content. As required by our Digital Content providers, certain Digital Content will, unless otherwise designated, only be available for use by users located in certain territories, and, accordingly, you hereby acknowledge that certain Digital Content may not be available (as a download, as a stream or both) if you reside in a territory that is restricted by our Digital Content providers. In respect of all territories where Digital Content is permitted, you represent and warrant that you reside in such permitted territories during the time while you are accessing Digital Content.

Owners of the Digital Content and/or their authorized agents are intended third-party beneficiaries under these Terms and may enforce these Terms against you.

Password Restricted Areas

You need a password to login to this Service, to use the Products, and to use or access certain functions and areas within this Service and the Products. You are responsible for maintaining the confidentiality of your password and account, and you agree to notify IMVU if your password is lost, stolen, or disclosed to an unauthorized third party, or otherwise may have been compromised. You are responsible for all activities that occur under your account, and IMVU is not responsible for any unauthorized use of your account in the event that your password is stolen or revealed to a third party. You agree to immediately notify IMVU of any unauthorized use of your account or any other breach of security in relation to this Service known to you. IMVU provides you with tools to change your password and to otherwise edit or safeguard your account on your account settings page.

You may not sell, transfer, give, or otherwise surrender your account or account password to another party. You agree that you will not use other users' contact information gathered from this Service for commercial purposes and agree not to provide any other user's contact information to any third party.

Terms and Conditions of Sale

Every order you place through IMVU or its vendors will be deemed your offer to purchase our Products. We may accept your offer either through an e-mail confirmation or through delivery of the items you requested. Our acceptance of each offer as specified is expressly subject to and conditional upon your acceptance of these (and only these) Terms, and our determination that the offer is based upon a legitimate intent to purchase. All prices we show on this Service are subject to change without notice. Prices stated at beginning of delivery apply. Applicable taxes or shipping and handling charges, which may not apply to IMVU Credits or virtual products (if any), are not included in the prices, but all such charges will be added to your invoice and will be visible at Check Out before you complete your purchase.

We will collect sales tax in the states we are required by law to do so. Thus we require your disclosure of state and country of residence when ordering. Applicable sales tax will be added to your purchase. All IMVU Credits, passes, Products, and all virtual products are non-refundable, except, in our sole and absolute discretion. Virtual products purchased will be available for use as soon as reasonably practicable.

Shopping should be fun, and we want you to feel safe and secure when you shop with us at IMVU. As you're shopping with us online, you may give us your payment information (e.g. credit card), and we take the responsibility of caring for that information very seriously. While no security system is absolute, we employ industry standard security systems that are reasonably designed to protect your personally identifiable information ("PII") including your payment information. Our servers protect your PII using encryption which can be identified (in most browsers) by the lock icon in the status bar on secure pages. Look for this icon on any web page that asks for your PII or payment information.

You agree to pay all fees, charges and/or associated taxes ("Fees") made to your account based on IMVU's fees, charges, and billing terms in effect as shown on the Buy Credits page and, if you are a registered Content Creator, the Developer Reports page. If you do not pay on time or if IMVU cannot charge your credit card, PayPal or other payment method for any reason, IMVU reserves the right to either suspend or terminate your access to the Service and your account and terminate these Terms. You are expressly agreeing that IMVU is permitted to bill you for the applicable Fees you may incur in connection with your use of this Service and the Fees will be billed to your credit card, PayPal or other payment method designated on your initial registration with this Service, and thereafter at regular intervals for the remainder of the term of these Terms. If you dispute these charges at any time, IMVU has the right to contest the dispute and you acknowledge that IMVU may furnish all details of the transaction to the governing body. If you cancel your account at any time, you will not receive any refund. If you have a balance due on any account, you agree that IMVU may charge such unpaid Fees to your credit card or otherwise bill you for such unpaid Fees.

When you purchase items or services on this Service such as Credits, credit bundles, avatar names and account upgrades, your purchases are non-refundable and are made at your own risk. IMVU is under no obligation to provide any refund (either in cash or in Credits) for any item made by a third-party developer that is broken, that later becomes disabled, that is later removed or altered by the developer or by IMVU, or that was inappropriately submitted. If you have any billing problem or question, please visit the IMVU Help Center. Additionally, if a catalog Submission item is removed from this Service as a result of an intellectual property infringement claim (or Unsuitable for IMVU content as set forth in the Virtual Goods Policy) and/or IMVU disables your use of such an item as set forth in these Terms, any cash or any Credits that you used to purchase such items will not be refunded.

We reserve the right to furnish materially equivalent substitutions for materials which cannot be obtained in sufficient quantities, or to cancel the excess portion of the order. We shall not be in default if delivery is delayed or rendered impossible by forces of nature, war, civil commotion, governmental action, terrorism, fire, storm, flood, explosion, strikes, walkouts, other industrial disturbances, utility, services or transportation interruptions, or any other cause beyond our reasonable control. We may revise or modify Products, Product information or pricing without notice. We are not responsible for typos, fax or printing errors.

Currency

The Service includes in-world fictional currencies ("Currencies" or "Credits" or "Promo Credits" or "Predits" or "Dev Tokens" or "DT" - all of the foregoing are "Credits"), which may be purchased with real world currency and can then be exchanged on this Service for limited license right (s) to use a feature of our Product or a virtual product when, as, and if allowed by IMVU and subject to the terms and conditions of these Terms. IMVU may charge fees for the right to use our Credits, or may distribute our Credits without charge, in IMVU's sole discretion. Regardless of terminology used, IMVU Credits are not redeemable for any sum of real world money or monetary value from IMVU at any time. You agree that IMVU has the absolute right to manage, regulate, control, modify and/or eliminate such Credits as it sees fit in its sole discretion, in any general or specific case, and that IMVU will have no liability to you based on its exercise of such rights. IMVU Credits cannot be used for any kind of wagering, betting or gambling either within or outside of our Site. You also agree to use IMVU's Credits for all transactions involving IMVU Products or virtual products and related use rights and you agree not to create, employ, or utilize any parallel form of virtual currency in connection with any transaction on this Service. IMVU may allow for free exchange of some, all, or none of its Credits via third parties, but IMVU does not assume any responsibility associated with your transactions with such third parties. IMVU is the sole owner of Credits, and as such, retains all intellectual property rights affiliated with ownership. You acknowledge that at no time do you own, nor have any right to, the intellectual property affiliated with Credits. You are hereby prohibited from reselling or distributing Credits without the expressed written consent of IMVU.

Third Party Content

Certain information and content that are not Submissions may be provided by third party licensors and suppliers to IMVU ("Third Party Content"). The Third Party Content is, in each case, the copyrighted and/or trademarked work of the creator/licensor. Unless you have permission from the owner of the Third Party Content or as otherwise set forth in these Terms, you agree to only display the Third Party Content on your personal computer solely for your personal use. You acknowledge and agree that you have no right to download, cache, reproduce, modify, display (except as set forth in this paragraph), edit, alter or enhance any of the Third Party Content in any manner unless you have permission from the owner of the Third Party Content or as otherwise expressly authorized in these Terms. You hereby indemnify and hold IMVU and all providers/licensors of Third Party Content harmless from any third party claims related to your use of the Third Party Content in any manner other than authorized hereunder.

Virtual Goods Policy

You agree to only create virtual products that comply with IMVU's Virtual Goods Policy, and to properly rate the content that you submit to the Service as set forth in the Virtual Goods Policy. Links to Third Party Sites

This Service may be linked to other world wide web sites that are not IMVU Sites. IMVU is providing these links to you only as a convenience, and IMVU is not responsible for such linked sites, including, without limitation, the content or links displayed on such sites.

Submissions

You acknowledge that you are responsible for the text, information, graphics, sounds and other material that you submit, post or otherwise make available on the Service, including without limitation, any "virtual products" or other items that you develop and make available on this Service (i.e. catalog content), avatar names, avatar profiles, profile snapshots or photos, avatar customizations, avatar actions, chat, message board or other forum communications and homepage contents (each a "Submission") through posting and chat areas, catalogs, emails, home pages, instant messaging, developer tools or other services available in connection with this Service, and that you, and not IMVU, bear full responsibility for each such Submission you make, including its legality, reliability, appropriateness, and trademark and copyright ownership. If you submit, post or otherwise make available on the Service any virtual products, you also agree to the terms of the Creator Program Participation Agreement.

Unless otherwise explicitly stated herein or in the IMVU Privacy Policy, you agree that any Submission provided by you in connection with this Service is provided on a non-proprietary and non-confidential basis. Except as expressly set forth below, you agree that IMVU is free to use a Submission on an unrestricted basis for any purpose and you grant IMVU a sublicensable, nonexclusive, worldwide, royalty-free license to (in any media, whether now known or not currently known or invented) link to, utilize, use, publicly perform, publicly display, reproduce, distribute, modify and prepare derivative works of the Submission.

Additionally, IMVU agrees that the use all of your Submissions will be in accordance with IMVU's Privacy Policy applicable to PII. YOU RETAIN OWNERSHIP OF ANY COPYRIGHTS OR OTHER INTELLECTUAL PROPERTY RIGHTS APPLICABLE TO ANY WORK OF AUTHORSHIP OR INFORMATION YOU CREATE AND SUBMIT TO IMVU, SUCH AS YOUR SUBMISSIONS. You further agree that you will not upload, post or otherwise make available on this Service any material protected by copyright, trademark, or any other proprietary right without the express permission of the owner of such copyright, trademark or other proprietary right owned by a third party, and the burden of determining whether any material is protected by any such right is on you. You shall be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights, or any other harm resulting from any Submission that you make.

You represent and warrant that: (i) you own all Submissions posted by you on or through this Service, or that you otherwise have the right to grant the licenses to IMVU set forth in this section, and (ii) the posting of your Submissions on or through this Service does not violate the privacy rights, publicity rights, trademark rights, copyrights, contract rights or any other rights of any person or entity, and (iii) all commerce related to the Service occurs on IMVU itself and is denominated in IMVU Credits (i.e. all off-site sale of content or services is expressly forbidden). You agree to pay and indemnify IMVU for all royalties, fees, damages and any other monies owing any person by reason of any Submissions posted by you to or through this Service.

Community Guidelines

Please refer to the Community Guidelines that govern user-generated content (excluding submissions made to the virtual catalog) and behavior.

IMVU reserves the right to (a) terminate your access to your account, your ability to post to this Service and (b) refuse, delete or remove any Submissions or reclassify Submissions and move them, for example, from "public" to "private" or "restricted/adult" status; for any action that IMVU determines is inappropriate or disruptive to this Service or to any other user of this Service with or without cause and with or without notice, for any reason or no reason. IMVU reserves the right to restrict the number of emails or other messages which you are allowed to send to other users to a number that IMVU deems appropriate in IMVU's sole discretion. IMVU may report to law enforcement or other appropriate government authorities any actions that may be suspicious or illegal, and any reports it receives of such conduct. These prohibitions do not require IMVU to monitor, police, or remove any Submissions or other information submitted by you or any other user, and IMVU disclaims any obligation or responsibility to do so.

You understand that your interactions and dealings with other users of this Service are solely between you and such other user. IMVU is not responsible for any loss, harm or damage of any sort incurred as a result of any such interactions or dealings, and IMVU has no obligation to become involved in any resulting dispute.

Unauthorized Activities

Submissions and unauthorized use of any Materials or Third Party Content contained on this Service may violate applicable laws and regulations. IMVU is for people to meet others from around the world, connect with their friends, chat with them, exchange messages,make meaningful connections, and be creative using avatars as the means of self-expression. The guidelines below take into consideration freedom of speech, rights of self-expression, and protection of individual rights.

IMVU asks that you respect the IMVU online community as well as all its individual participants. Your conduct should be guided by these community guidelines, our terms of service, and also common sense and basic etiquette. IMVU strives to create an enjoyable place for all our users - who are 13 or older and from all across the globe. Additionally, our customers's engage in self-expression utilizing virtual products available in our catalog. Those products are created and rated by our Content Creators and are expected to comply with our Virtual Goods Ratings Policy.

As you join and enjoy being part of our community, it is important for you to understand what virtual content and user behavior is okay and not okay. Please read the guidelines below and take them seriously - we certainly do. Take these to heart and respect the spirit in which they were created so you and others enjoy the IMVU experience to the fullest.

We strive to ensure right content is in the right place and shown to the right audience. We have several age separation, content separation, and word filtering measures in place to do so.

Remember, you might not like everything you encounter on IMVU. Some of the content might offend you or may not suit your taste, sensibilities, or convictions. We provide you tools to block users sharing such content. Additionally,if you find certain content, behavior, or users to be inappropriate in the context of these guidelines, you may also use our reporting tools to bring it to IMVU's attention. We do review all such reports and take actions as necessary.

Guidelines for user behavior

Having a great experience on IMVU means you will be interacting with our service and other community members. Being respectful of others and our policies is critical. Use common sense as you interact with others, think if you would say the same things if you were talking to that user in person, and please be polite. Freedom of speech and having an opinion does not mean you can be abusive, hateful, or disruptive.

Here are guidelines to follow:

Harm to minors: IMVU community includes users 13 and older. Keep that in mind and do your part to keep the experience safe for minors.

Do not post anything or participate in any activity that exploits children or minors.
Sexualized "age play" (regressive role-play in which one or more characters is a minor) is not allowed - ever
Non-sexualized "age play" where avatars role-play as children as part of a family unit for example is allowed.

Bullying and harassment: Be nice - yes it is as simple as that. Do not bully, threaten, or harass anyone.

Do not participate in hate speech or be hateful to others based on their race, ethnicity, profession, appearance, medical condition, etc.
Do not target individuals to degrade or shame them.
Do not post personal information about others.
Do not be vulgar, abusive, or sexually explicit in conversations where other parties are not happy about such conversations.
Do not be disruptive, abusive, or vulgar in your posts, messages, or chats (passionate discussions happen, people get upset and say things in heat of the moment, however continuing such behavior to the extreme where all other participants in the chat are offended is not okay).
Do not monopolize or disrupt the flow of a chat room by sending repeated characters or words. If others are telling you to stop, you are negatively impacting others' experiences.

Sexual or adult-oriented behavior: IMVU is about self-expression and connections but not about lewd or sexually explicit behavior when all users involved are not willing participants. You will meet people with diverse cultural backgrounds. Do not make them uncomfortable by behaving in a way that would be considered inappropriate by societal standards if you were to do so in person. Respect the difference between private and public communications.

Do not use explicit and obscene language.
Do not engage in sexual solicitation.
Do not engage in adult-themed or sexually oriented activities unless, you as an adult have an Access Pass and are interacting with other Access Pass holding adults. Think of movies where certain behavior is okay for an R-rated movie but not a PG-13 rated one.

Age misrepresentation: IMVU is for all users 13 and older and we maintain some separation between users who are 13 to 17 and those who are 18 and older. We require you to state your correct age when you register for an IMVU account.

If you are adult (18 or older), you must represent yourself as an adult.
If you are a minor (13 to 17), you must represent yourself to be your actual age.

Spam, scam, fraud: IMVU is an online service and has the same rules like any other internet service you participate in.

Do not impersonate or represent IMVU, or our staff.
Do not ask for another userIMVU's password, or account information.
Do not share, give away, trade, or sell your account.
Do not post links to fraudulent websites or phishing sites.
Do not harvest user names, avatar names, addresses, homepage URL's or email addresses for any purpose other than your personal use in your interactions on IMVU.
Do not post any unsolicited or unauthorized advertising, promotional materials, 'junk mail', 'spam', 'chain letters', 'pyramid schemes', or any other form of such solicitation.
Do not discuss or incite illegal activity.
Do not engage in any activity that is meant to alter or interfere with IMVU's site, Products or operations by employment of 3rd party scripts, code, bots, etc.
Do not remove, hide, or obscure access to IMVU tools used to report a user or their behavior.
Do not take advantage of bugs or glitches, if you encounter them, in a manner that is malicious and fraudulent. We expect you to report such issues to IMVU and not use them as workarounds to bypass our policies and guidelines. Failure to follow this guideline has consequences and may result in action against your account.

PhotoSensitive Epilepsy (PSE): We want everyone to enjoy IMVU and getting headaches, nausea or worse - seizures is not going to let them do that. Please do your part by not posting images that have fast-flashing effects, strobe lights, contrasting visual patterns, or anything that would cause visual discomfort. Ratings for Virtual Products distributed via our catalog

The guidelines and rating categories listed in this section are only applicable to virtual products submitted to IMVU's catalog. Specifically, the Virtual Goods Policy does not apply to content like avatar images, photos, interest panels, pulse updates, forum posts, taglines, in-room chat, or messages. As an example, it is not okay for a minor on our service to purchase a virtual cigarette or glass of wine however, it is acceptable for them to view images of such products or post comments about smoking and drinking alcohol (remember, your mom is still going to say it's bad for you).

Virtual products available in our catalog fall under one of these three categories - two of which are allowed per our policies. Content Creators are required to comply with these rating determinations when they submit their products to the catalog so our community members may only consume appropriately rated content.

General Audience (GA): Virtual goods available to all users 13 and over. Think of PG-13 rating for movies, TV-14 rating for television shows, or Teen rating for video games. Registering for an IMVU account requires you to be at least 13 years of age.
Access Pass Only (AP): Virtual goods available (and shown) only to users aged 18 years or older who have purchased the Access Pass available from IMVU. Think of R or NC-17 rating for movies, TV-MA rating for television shows, or Mature rating for video games. Access Pass is only available to users who are 18 years of age or older, regardless of parental permission.
Unsuitable for IMVU (UFI): Virtual goods rated UFI may not be used/distributed anywhere on IMVU. Think of pornographic material, graphic, intense and sexual violence, and extreme harassment content including but not limited to racism and hate speech or actions.

The rating system is based on current societal norms and reflects standards used by commonly consumed content via movies, television shows, video games, and digital apps. If you as an IMVU user find an incorrectly rated virtual product being distributed or used, you can bring it to our attention via the reporting tools we provide.

Guidelines for user-generated (non-product) content - text and images

The guidelines and policies listed in this section are applicable to all text and image-based content shared by our community members via their profiles, photos, chats, messages, posts, etc. The product rating guidelines serve as a reference point for other content and user behavior in general but are not directly applicable. As an example, in real life, a minor is not allowed to consume alcohol, however, is allowed to see alcohol being consumed by others.

We want to balance self-expression and creativity with an enjoyable experience for our global community members in the context of current societal norms.

As you participate in the IMVU community, you will be sharing content that is viewable by all (photos, profiles) or by few (messages, chats). Be conscious of what you are sharing and who can see it. For obvious reasons, information and content that is viewable by all must follow stricter criteria for appropriateness.

Do not post content or images that involve:

Nudity - This includes real-life, avatar-based, or digitally-created photos showing genitals, female nipples, or nude buttocks (including most G-strings and thong-covered buttocks). Minimum coverage guidelines applicable to virtual products distributed in the catalog are not applicable to images.
Vulgarity or strong obscenities - This includes derogatory, sexually explicit terms. However, mild profanity including sexually-derived expletives (example: the "F" word) - is okay in user to user communication but not when used in places shown to all (example: avatar or room names).
Illegal activities - This includes drug usage and references (not including marijuana), murder, and sexual violence. Referring to tobacco and alcohol is okay. References to abusing prescription drugs is not okay.
Self-harm or mutilation
Animal cruelty, gore, or bestiality
Pornography or sexually explicit activities - This includes depictions of sexual acts, and intercourse. The dictionary definition of pornography is "explicit descriptions or displays of sexual organs or activities intended to stimulate erotic rather than aesthetic or emotional feelings"
Hate speech and harassment of others - this includes but is not limited to Nazi symbols, Confederate Battle Flag, propaganda related to known terrorist organizations, and any slurs based on race, religion, ethnicity, sexual orientation, and gender.
Consumption of alcohol/tobacco/marijuana (if you are a minor): This applies to IMVU users who are 17 and under. They may not post images depicting use of alcohol, tobacco, or marijuana.

What happens if you do not comply with IMVU policies

We want everyone who joins IMVU to have fun with their friends and make new friends. To ensure the experience is fun for everyone, we offer tools so our users can block others and report to us anyone or any content that is not compliant with our policies. We review all such reports and take action as necessary. If your content or behavior is reported under this process, we will review and warn you so you do not repeat such behavior or share such content. We may also disable your account as per our Terms of Service so that you can no longer participate in the IMVU community.

IMVU Submitted Virtual Goods Rating Policy


The purpose of this policy is to lay out a framework for acceptable virtual goods, submitted and/or either sold or distributed via the IMVU catalog. The policy is intended to help Content Creators who create and submit virtual goods for our catalog. This policy does not cover user behavior with or without goods, in any of IMVU's social mediums. Specifically, this policy does not apply to avatar images, photos, interest panels, pulse updates, forum posts, taglines, in-room chat, or messages. Please refer to the IMVU Community Guidelines for any user behavior and non-product content policies. Rating standards apply differently to virtual products that a IMVU customer may consume via his/her avatar versus content he/she may view or refer to. As an example, a virtual cigarette is not a product that can be purchased in IMVU's shop by general audiences, however viewing a photo of someone smoking a cigarette is okay for our 13+ audience. Our 18+ audience may also share a photo of someone smoking.

For the purpose of this policy, a virtual good is considered: any product submitted to the IMVU catalog for distribution or sale by any party (IMVU or User) that can be used in any of IMVU's social channels, including, but not limited to: 3D objects, 2D objects, meshes, poses/animations, textures, sounds, interactive games, multi-state objects (3D & 2D), gadgets/widgets, streaming objects, compilations of objects (outfits, collections, etc), packaged experiences or any combination of the previous items (ex. A 3d object + pose + texture). Both virtual goods and product pages merchandising those virtual goods are held to the same standards.

IMVU is a large global community made up of users age 13 and up, including all races, nationalities, and backgrounds. Because of the diversity of our community IMVU needs a comprehensive virtual goods rating process in order to satisfy the needs of various users, be it age, culture, or local laws in order to provide the best possible user experience. Therefore IMVU's policy goals are to:

Categorize virtual goods with the purpose of being submitted to IMVU's catalog for distribution into three easy to understand and segmented categories,
Limit IMVU's business to the first two categories, General Audience (GA) and Access Pass Only (APO); with the APO category restricted to users that purchase an Access Pass.
Provide direction for merchandising and coverage of the goods - and not behavior

Categorizing content into three categories

IMVU employs a product rating system that seeks to identify those items which are acceptable to all users, versus those acceptable only to an adult audience. We also define items that are unacceptable at IMVU to any audience.

Our three rating categories are:

General Audience (GA)
Access Pass Only (AP)
Unsuitable for IMVU (UFI)

IMVU's content policy strives to do its best in identifying clear guidelines between categories, but, as with any policy, it is impossible to do so without incurring some disagreement. Flexibility is necessary for any long standing policy. We feel this policy will allow IMVU and the community to adapt to global cultures laws, and to accommodate our community's virtual goods needs as best as possible. Ultimately, if you as a IMVU Creator are submitting a product then please take the rules laid out in this policy seriously. Respect the spirit in which they were created and do not try to create content that intentionally veers into gray areas and tests the limits of the rating guidelines. IMVU is not for violent, abusive, harassing, or sexually explicit content. If any of these describe your products, donIMVU'st submit them.

Rating names

The rating names and definitions are as follows:

General Audience (GA) - Goods available to all users. Users are required to be 13 years or older, as laid out in the IMVU TOS;
Access Pass Only (APO) - Goods available only to users aged 18 years or older who have purchased the Access Pass product. The Access Pass is only available to users who are 18 years of age or older, regardless of parental permission;
Unsuitable for IMVU (UFI) - Goods rated UFI will not be available anywhere on IMVU's website nor will they be usable in any IMVU social platform.

Clarification on ratings

IMVU's rating policy assigns a virtual good a rating based on how well it fits within the one or more of the various categories below. It is possible for an item to fit into multiple categories. Due to this issue if an item falls into any of the APO or UFI categories, then it will be classified as APO or UFI, as appropriate, regardless of other attributes. The rating system is based on current societal norms and reflects standards used by commonly consumed content via movies, television shows, video games, and digital apps.

Blood (GA) - Depictions of blood (non-animated).
Body Modifications (GA) - Any alterations to the avatar's physical form (ex. Robotic limbs, tattoos, piercings, etc).
Cartoon Violence (GA) - Violent actions involving cartoon-like situations and characters. May include violence where a character is unharmed after the action has been inflicted.
Comic Mischief (GA) - Depictions or dialogue involving slapstick or suggestive humor.
Crude Humor (GA) - Depictions or dialogue involving vulgar antics, including 'bathroom' humor and mild sexual references.
Fantasy Violence (GA) - Violent actions of a fantasy nature, involving non-human characters in situations easily distinguishable from real life.
Gaming (GA) - Users can play a game, including those of chance, without betting or wagering real or virtual currency.
Mild Violence (GA) - Virtual goods depicting characters in mild unsafe and/or violent situations. Also includes realistic weapons that are not used against other avatars or whose intent is not obvious or aggressive harm of other avatars.
Mild profanity (GA) - Sexually derived expletives ("f" words).
Romantic content (GA) - Romantic situations, poses, actions.
Marijuana, tobacco, and alcohol references (GA) - Names of marijuana, tobacco and alcohol products and photos of such products.

Access Pass Only (APO)

Alcohol, Tobacco, and Marijuana Use (APO) - Products that allow avatars to smoke tobacco and marijuana or consume alcoholic beverages that are clearly labeled as such. If a product allows someone to mimic smoking and drinking then it is considered APO.
Blood and Gore (APO) - Depictions of excess/gratuitous blood or the mutilation of body parts.
Nudity (APO) - Virtual goods depicting full or partial nudity, including but not limited to nude humans, nude avatars, skins, and/or products (transparent or otherwise) that cover less than the GA minimum coverage guidelines below. Depiction of uncovered female breasts and un-aroused male or female genitals are considered part of this category. Products that may meet the minimum coverage guidelines but due to enhancements/enlargements of avatar bodies and parts project the sense of nudity fall under this category as well.
Profanity (APO) - Obscene, lewd, sexually crude or abusive language. Products that include such content in them - voiceboxes, images on clothing fall into this category.
Themes (APO) - Moderate to heavy sexual references and/or depictions. Includes any sheer/transparent lingerie and undergarments even if they meet the coverage guidelines. Intimate avatar poses, including but not limited to avatar lap straddling, are considered Access Pass Only except in cases where they are sexually graphic and/or explicit in which case they should be considered UFI. If a product allows an avatar(s) to mimic sexual acts (but not intercourse) then it falls into this category.

Cruelty to Animals (UFI) - Any act, depiction or suggestion of extreme violence/sex toward animals.
Discriminatory Content(UFI) - Anything that overtly harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, nationality, lifestyle or disability. Products that include such content as voice boxes, images on clothing or furniture items etc fall under this category.
Drug Use(UFI) - Products that allow an avatar to mimic using or producing illegal drugs (does not include marijuana/pot) fall under these category.
Harm to Minors (UFI) - Any act, depiction, or suggestion of violence, or sex, to/with minors (anyone under the age of 18).
Hate Products (UFI) - Virtual goods which represent, promote, advertise, or in any way support, display or depict characterizations of hate-based and terrorist organizations (ex. Neo-Nazi, KKK, ISIS, gangs) or symbolize oppression toward a race or ethnicity (ex. Confederate flags).
Malicious Content (UFI) - Any virtual goods created to intentionally or otherwise malign another user or degrade user experience. This includes products whose total derivation size exceeds 8 Megabytes. This also includes products that produce flashing/strobing effects that can induce photoepileptic seizures (PSE).
Nudity: aroused genitals (UFI) - Depictions of aroused genitalia and/or unrealistic or overly detailed genitals.
Personal Data (UFI) - Anything that includes personal or identifying information about another, real-life person.
Sexual Violence (UFI) - Any act, depiction, promotion, or suggestion of rape or other violent, non-consensual sexual acts.
Strong Sexual Content (UFI) - Graphic references to and/or depictions of sexual acts including, but not limited to, penetration/intercourse, and/or oral sex with or without another avatar or any other object; additionally, this includes any overt sexual toys and/or aides.
Suicide (UFI) - Any act, depiction, promotion, or suggestion of/to suicide.
Violence (UFI) - Virtual goods involving graphic violence, dismemberment, self-mutilation, homicide; anything depicting extremely grotesque images or acts.
Wagering (UFI) - Any betting or wagering of real or virtual currency. This includes URLs or references that lead to gambling sites outside of IMVU.com. Payouts that are carried out outside of IMVU are also prohibited.

Rating assignment and determination

Under the current system, ratings are assigned by the content creator creating the product or by customer service upon review of a flagged product. Users have the ability to determine if their product is GA or APO, however please bear in mind that if a product originally rated as GA is flagged and found by IMVU customer service to be, as an example, APO, then it will be hidden and/or re-rated APO unless IMVU and the original creator can resolve the issue. Virtual Good Ratings only apply to a finished product submitted to the catalog (which include but is not limited to the product itself, the entire contents of the product info page, and the product catalog picture), and it is up to the final product submitter to comply with the rating policy, and address any concerns raised by IMVU or another user.

The final rating of a product depends upon all of the attributes of that product and what sub-categories those attributes fall into. So it is possible for a product to be both GA & AP at the same time, but only one rating in the end can be applied. If a product does apply to multiple sub-categories and thus has multiple ratings, then the most restrictive category will apply: If a product is both APO and GA, then the product will be rated APO, and if a product is UFI and APO and/or GA, then the product will be rated UFI.

Let's use two examples to illustrate this.

Example 1: Original object created using all GA parts from one Creator.

Using the graphic below as an example, Creator Bob takes 3 objects (A, B & C) in step 1 all of his own creation, assembles them into a final object (D) in Step 2, and then submits Object D to the catalog, Step 3. Since Object A is a seat node (GA), Object B is a chair mesh (GA), and Object C is a solid blue texture (GA), he rates his item as GA, since none of the individual items or the whole match any APO sub-categories.
Example 2: Object created using parts from 3 creators

Lets use the same graphic as above for this example. Creator Bob wants to create Object D (A bar scene), so he takes Suzy's Object A (A room; GA), Jack's Object B (A counter; GA), and Mark's Object C (A beer can labeled 'Beer'; APO). Both Suzy's and Jack's objects (A & B respectively) are rated GA. Mark's object (C) is rated APO (since it is Alcohol Use & Reference). After Bob assembles the parts into Object D, he then goes to submit the product. Bob knows his product contains an APO Object, and thus rates his product as APO since he did not alter Object C to make it GA. Thus the rating of Object C (APO) trumps the ratings of A & B (both GA) and the final product (a bar scene) is rated APO.

Poses as a product

A pose is a product, therefore it is subject to the same rules as any other product. Ex. If the pose is shaking hands, that's GA, if it sexual intercourse that's UFI.

As defined at the top of the document a pose, by itself, is a virtual good as any other. If a pose is combined with another object then it must adhere to the same rules as described in the "Rating assignment and determination " section. The final rating for the combined object is what matters.

For example, if you take a hand-shake pose and add it to a seat node on a couch, the pose is GA, the couch is GA, and therefore the final product Couch + Animation is GA. If you take a bed (GA) and add a sexual intercourse pose (UFI) than the final product Bed+Pose is UFI, the bed itself remains GA.

Merchandising

Merchandising behavior

All products must have a product information page to merchandise the product, regardless of whether or not the product is hidden. Product information pages must also adhere to the rules laid out in this Virtual Goods Policy. For the purposes of clarity, everything on the product information page including but not limited to the product description, any image(s), keyword(s), and the product itself, are considered part of the product and thus affect a product's rating. Merchandising for a product includes, but is not limited to: the product name, description, category, icon, and tags. The main method for merchandising a product is the product information page.

All product merchandising needs to adhere to the same rules as the product category and rating the product has been assigned to. This means that any GA product can only have a product name, icon, product page, and tags that adhere to the GA rating and categories. Similarly, APO items must only contain content that is suitable to GA or APO. No product page, regardless if it is GA or APO, may contain any UFI content.

Examples:

A product page for a simple chair, which is rated GA, is acceptable if: it is titled "Chair"; its catalog icon is a picture of the chair; and the description said "This is a chair for sitting on." This product page would be GA and acceptable.

A product page for a simple chair, which is rated GA, is unacceptable if: it is titled "Chair"; its catalog icon is a picture of the chair; the description says "This is a chair for smoking crack-cocaine."; and the tags are 'chair, blue, crack-cocaine'. This product page and tags would be UFI (For Drug Reference), and thus, the product and product page would be UFI.
Obvious intent and combination of products

Items submitted to the catalog are subject to penalty whether or not the violation is evident in the product description, provided images, or in combination with other items, if they violate this policy. Combination products, those that are broken into pieces and distributed as such, with the intent for re-assembly, as well as those with "hidden features", may be found to violate the IMVU TOS or this policy unless all of the following statements are true:

There is clear, legitimate, and normal use of each individual product that does not violate the TOS or this policy.
The primary or normal use of the individual product does not violate the TOS.
The provided product description and images do not suggest violations of the TOS or this policy, and the hidden features do not violate the TOS or this policy.
Each individual product is properly rated.
The whole constructed product does not violate the TOS or this policy.

While the combination of items by a 3rd party is outside any the original creator's control, if the combination of products implies obvious intent, all parties will be held responsible.

For example: Someone creates a ten foot statue of a phallus and then proceeds to chop it up into 5 unassuming blocks. Each block is submitted as an individual product which is rated General Audience. However, when all of the individual block products are put together, they become a phallus (the original product). The resulting combination of products is unsuitable for General Audience and so the intent is obvious. Therefore the individual products in this case will be reviewed and re-rated and the creator will be held accountable under the TOS.

Combined words

While certain words have been identified above as NOT being APO, combination of words can cause an APO rating. Furthermore, all combinations of words must adhere to the IMVU TOS.

Clarification on 'Product' problems vs. 'Product description' problems

A product can be found guilty of violating the General Audience rating for several reasons. If a virtual good contains any of the elements listed in the APO/UFI section above, that product will be marked as not General Audience regardless of any other attribute.

However, even if the actual product meets the General Audience criteria, it can still be marked as not fit for General Audience for reasons including but not limited to: inappropriate content in the product's catalog image, product's name and/or product's description.

For example, when selling a skin tone, it is *NOT OK* to show a picture of a naked avatar and still mark that product as General Audience. Instead, you must use the minimum coverage guidelines below to display an avatar wearing enough to not be inappropriate but also show your product.

Similarly a product page may not show a GA item and then market it with language not suitable for General Audience.

Minimum Coverage

At IMVU we subscribe to the rule that coverage is as important as the type of product created. Whether you are creating a 3D object (mesh, finished object, animation, etc.) to be used with an avatar, or a 2D (sticker), any depictions of an avatar, human, animal, etc., must adhere to the same coverage guidelines and ratings categories.

The images below define the minimum content coverage for General Audience for both female and male avatars. Any article of clothing (lingerie, underwear, shirts, beachwear, etc.) must adhere to the coverage guideline. If the item is going to be classified as GA, it must also be 100% opaque (i.e. NOT sheer or transparent).

General Audience items MUST cover the areas in red below. Additionally, GA clothing items must cover the red areas shown below in a manner that is commonly acceptable to IMVU's GA audience (i.e. no 'pasties').

There are ways of getting around this "minimum coverage" approach so please do not consider the absence of red or orange a ticket to a General Audience rating. Your products, product catalog images, product descriptions, product names and avatar pictures must adhere to all of the criteria listed above.

Testing Minimum Coverage

An animation has been added to the messenger to help test for minimum coverage. If you want to use this animation, please type *use 2111 in the messenger. Please remember to wear the minimum coverage skin as well as your product that you want to test and then use the animation.

Un-aroused guidelines

While a product that contains any aroused body part is Unsuitable for IMVU (UFI), un-aroused genitalia is permitted for Access Pass Only products. However, un-aroused genitalia of inappropriate size is not permitted. The bright green portion of the image below shows the relative size that is acceptable for un-aroused genitalia.

Music-Related Information

The following information pertains to music-related products.
Music Length for non-IMVU Music Mix Service Products

Any virtual good that includes any embedded audio not from the IMVU Music Mix Service (includes, but not limited to: music, sound effects, voice), will be automatically adjusted to only play a maximum of 20 seconds of the source file. Any audio from the IMVU Music Mix Service will be the full-length of the source file.

Any product that contains any audio (including but not limited to: music, sound effects, voice) that is not part of IMVU's Music Mix Service, must contain the following disclaimer prominently placed within the product description OR on the product information page without any alterations and must be legible:

This product contains audio that is not part of IMVU's Music Mix Service and thus may be limited to a maximum of 20 seconds of audio only.

Photosensitive Epilepsy (PSE)

Products submitted to the catalog should not have characteristics that may trigger a PSE episode for users who suffer from such symptoms. Items that have the following characteristics are considered violations of the VGP:

Flashing images should not flicker faster than three times per second
Flashing images should not be displayed for a total duration of more than two seconds
Flashing images must have at least a two second pause between each series of flashes
Flashing images should not have high luminosity (bright or neon colors)
Flashing images should not involve bright colors alternating with dark, or light bars against a dark background
Flashing images should not have intense red flashing with any other color
Stripes, whirls and concentric circles should not take up more than 25% of the image If you are concerned about PSE, you may wish to use the Photosensitive Epilepsy Analysis Tool (PEAT) to assess PSE risks in your content prior to submitting it to the catalog. PEAT can be downloaded here. IMVU does not endorse or promote this tool and only provides information about this tool for your convenience. Terms of Service violations

In addition to the restrictions set forth by the sub-category definitions, products submitted to the catalog must adhere to the general IMVU Terms of Service.

Copyright/TM violations

IMVU prohibits the submission of Copyright and Trademark violations to the IMVU catalog. To learn more, please read the Copyright and Trademark Infringements section of the Terms of Service.

Final Rating Assignment

In all cases of content ratings, IMVU maintains the right to be the final arbitrator of an item's content rating and any action taken to support that rating or punishment involved in a policy violation.

Changes to the Policy

IMVU reserves the right to change any portion of the Virtual Goods Rating Policy to fit new requirements to its business (ex. Changing laws) at its discretion. IMVU also reserves the right to create sub-policies for specific countries where required. All changes will be posted on the IMVU Site.

Final provision

The English text of these User Terms constitutes the sole authentic text. In the event of any discrepancy between the English text and a translation into a foreign language, the English text shall prevail.
